KOLKATA: The Bengal govt has given sanction to CBI to prosecute former R G Kar principal Sandip Ghosh, implicated by the central agency for corruption.
The CBI on Nov 29 submitted an 80-page charge sheet in court against Ghosh, and this nod was required under Section 218 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) for the trial to start. The Calcutta High Court on Tuesday asked the special CBI court to frame charges against Ghosh within a week and expedite the trial.
The CBI informed the high court on Tuesday that it received the prosecution sanction against Ghosh. The high court was hearing a plea filed by former deputy superintendent at R G Kar, Akhtar Ali.
Justice Tirthankar Ghosh ordered, “I direct the special court that within a week from the next date fixed, all endeavours be made for consideration of charges. The special court would consider a list of witnesses and accordingly schedule so that the trial can be expedited and taken to a logical conclusion.” The HC will hear the case on Jan 30.
Based on the directions of the Calcutta High Court in Aug 2024, the investigation into the corruption allegations at R G Kar, implicating Ghosh, was handed over to CBI from a state police Special Investigation Team (SIT).
The high court transferred the case to CBI, stating that multiple agencies handling different aspects of the case could lead to “inefficiencies or inconsistencies”.
Akhtar Ali, the ex-RG Kar staffer, moved HC, demanding a separate ED probe in the R G Kar issue. Additional Solicitor General (ASG) Ashoke Chakraborty submitted that the Enforcement Directorate (ED) already registered an ECIR, and the agency conducted as many as 22 searches for tracing the money trail.
Ali mentioned before Justice Ghosh again on Tuesday, complaining that the information he gave to the local police on the alleged corruption was not properly probed.
ASG Chakraborty submitted a CBI status report to the court on this case. Ali’s lawyer cited that the CBI in its report mentioned the need for further investigation into the “larger conspiracy” to determine the roles of other accused persons, including Ghosh.
Justice Ghosh directed the central agencies to take steps on the materials already collected if all that made out a case for further trial.
