HYDERABAD: In a temporary relief to an Indian-origin software professional currently working in the US, the Telangana high court suspended a look out circular (LOC) issued against him by the Cyberabad police in a case for harassment filed by his wife.
Since he has been staying there on a job visa from even before the case was registered against him in April 2024, and is now planning to come to India for personal reasons, he filed a writ petition before the high court stating that he fears being arrested when he arrives in India .
After his counsel assured the court that he would cooperate with the trial, the high court issued orders suspending the LOC for a period of two months.
The court also directed the petitioner, currently residing in Texas, to file an undertaking that he would appear before the court as and when required. “The trial court shall impose further conditions as may be necessary to ensure his appearance for trial. He is also given liberty to file an application for recall of NBWs, if any, issued against him,” said the high court.
The HC also directed the petitioner to approach the trial court for permission if he intends to go back to the US or any other country.
“If permission is granted, the trial court shall pass an order suspending the LOC issued against him for the corresponding period from time to time,” said the court, posting the matter to Feb 6.
Earlier, the petitioner’s counsel also informed the high court that he already filed a divorce petition in the family court in Guntur district — the place he originally belongs to — and his wife also filed a maintenance petition in the Ranga Reddy district family court.
In response, the assistant govt pleader informed the high court that the police have already filed a chargesheet in the trial court and are waiting for the trial to begin.
