Amity student held for death of friend, abetment case lodged

NOIDA: A second-year Amity University student has been arrested on charges of abetment to suicide for the death of her classmate, who allegedly jumped to death from the seventh floor of a condominium in Sector 99 last Saturday.
The two were at the apartment in Supreme Towers with four more friends at the time of the incident. His body was found in a secluded section behind the tower that had been blocked for construction by the builder.
There was no note from him, but the woman was arrested after the classmate’s father accused her of harassment. “The father of the boy submitted a complaint on Saturday night and subsequently an FIR under BNS Section 108 for abetment of suicide was filed. We have investigated the case from all possible angles and, thereafter, she was arrested and produced in court on Monday,” DCP (Noida) Ram Badan Singh told TOI.
Police sources said the two had been in a relationship for two years but had parted ways. “Preliminary probe shows the woman told her family about her relationship, but they did not approve of the match. The classmate apparently couldn’t handle it. Around 3pm on Saturday, the friends had gathered at the flat, which was a shared accommodation of two of the students, for a party. The conversation apparently had freewheeled towards their relationship, which upset him,” the officer said.
The body was found around 4.30pm.
Police did not clarify what the evidence against her was, which had led them to make an arrest.
In Oct 2024, Supreme Court had clarified conditions for establishing the offence of abetment of suicide, ruling that a mere allegation of harassment of the deceased would not be sufficient and there must be such action on the part of the accused that left the deceased with “no choice” and such instigation must be in close proximity to the act of committing suicide.
A bench of justices JB Pardiwala and Manoj Misra said, “The ingredients to constitute an offence under Section 306 of IPC (abetment of suicide) would stand fulfilled if the suicide is committed by the deceased due to direct and alarming encouragement/incitement by the accused leaving no option but to commit suicide.” (The ruling mentioned IPC because this was an old case. The corresponding section is now part of BNS, the new penal law that came into effect last year)
Police said they had questioned the other students who were present at the flat and released them.
Autopsy report indicated injuries in the thorax, chest, abdomen, pelvis, upper and lower extremities.
